LAUNDRIES (PERBADANAN PUTRAJAYA) BY-LAWS 1999

IN exercise of the powers conferred by section 73 of the Local Government Act 1976, the Perbadanan Putrajaya makes and pursuant to section 103 of the said Act the State Authority confirms, the following by-laws:

Citation, application and commencement

1. These by-laws may be cited as the Laundries (Perbadanan Putrajaya) By-Laws 1999 and shall apply only to Kawasan Putrajaya and shall come into force on the date of its publication in the Gazette.

Interpretation

2. In these by-laws unless the context otherwise requires-

  • "authorised officer " means any officer authorised in writing by the President;
  • "clothes" includes clothing, towels, linen, carpets, rugs, cushion covers, bed covers, table cloth, blankets, pillow covers, bedsheets, curtains or any other washable or dry cleaning items;
  • "Kawasan Perbadanan Putrajaya"means the Kawasan Perbadanan Putrajaya as described in Section 10 of the Perbadanan Putrajaya Act 1995;
  • "laundry" means any place designated by the Perbadanan, building or part of a building where clothes are washed, dried or pressed and includes steam laundries, dry cleaning establishments and launderettes;
  • "licenced premises" means any premises licenced under these by-laws and shall include the land appurtenance thereto;
  • "Perbadanan" " means the Perbadanan Putrajaya established under Section 3 of the Perbadanan Putrajaya Act 1995;
Licence for laundries

3. No person shall use any place or premises as a laundry in Putrajaya without a licence issued by the Perbadanan.

Application for licence

4.

(1) An application for a licence under by-law 3 shall be made to the Perbadanan in such form and manner as the Perbadanan may determine.

(2) The Perbadanan may require any applicant for the issue or renewal of a licence to attend in person or in the case of a corporation or firm, may require an authorised representative of that corporation or firm to attend at the time of issue or renewal.

(3) Upon approval of the application, the Perbadanan shall issue a licence subject to -

(a) payment of RM600.00 per annum ;
(b) such conditions and restrictions as may be specified therein; and
(c) payment of a deposit of such sum as the Perbadanan may determine.

(4) The licence shall be in such form as the Perbadanan may determine.

(5) The Perbadanan may issue a licence for any period not exceeding three years and is renewable, subject to an application for renewal being made to the Perbadanan three months before expiry and the payment of the fee as set out in the Schedule on or before the date of expiry.

(6) Where any period of a licence is less than a year, the fee payable for such licence shall be calculated on a month to month basis based on the rate as set out in the Schedule, and for the purpose of this by-law, part of a month shall be deemed to be a month.

Fee not refundable

5. Fee paid for a licence issued under by-law 4 shall not be refundable.

Refund of deposit

6.The deposit paid under by-law 4(3)(c) shall, unless forfeited under by-law 8, be refunded with no adjustment for interest on the amount deposited by the licensee after the licensee has ceased operating laundry and upon surrender of the licence to the Perbadanan in the event that the licence has not expired.

Notice of cessation

7. The licensee shall notify the Perbadanan in writing as soon as he has ceased operating the laundry.

Forfeiture of deposit

8.

(1) The Perbadanan may forfeit the deposit in whole or in part if the Perbadanan is satisfied that there has been a breach of the conditions or restrictions of the licence or contravention of the provisions of these by-laws.

(2) Upon forfeiture of such deposit, the licence shall be deemed to be cancelled, unless the Perbadanan on the application of the licensee allows the licence to continue to be in force subject to repayment of the deposit that has been forfeited.

Revocation of licence

9. The Perbadanan may at any time revoke any licence issued under these by-laws if the authorised officer of Perbadanan is satisfied that there has been a contravention of these by-laws or a breach of the conditions of the licence:
Provided that the Perbadanan shall give a written notice to the licensee two weeks before making such revocation.

Licence is not transferable

10. Licence issued under these by-laws is not transferable unless permitted by Perbadanan in writing.

Cleanliness of employee

11. Any person employed in a laundry shall maintain his body and clothing in a state of cleanliness.

Persons prohibited to work in laundry

12. No person -

(a) who is suffering from a communicable disease;
(b) who is a carrier of any infectious disease;
(c) who is suffering from any condition causing a discharge of pus or serum from any part of the body or other skin ailment;
(d) who has reason to believe or suspect that he is likely to transmit disease-producing organisms;
(e) who is in contact with any person suffering from a communicable disease; or
(f) who is not in possession of a valid Medical Certificate issued by a registered Medical Practitioner.

shall be engaged to work in a laundry nor be present at the place or premises where the business of laundry is carried out.

Medical examination

13. Every person working in a laundry shall undergo a medical examination once a year for the purpose of by-law 12.

Occurrence of disease to be reported

14.

(1) The occurrence of any infectious or contagious disease in any premises used as a laundry shall immediately be reported to the Perbadanan by the licensee.

(2) No licensee shall receive any article whatsoever from or belonging to or used by any person living in any house or institution where there is an infectious or contagious disease.

Cleanliness

15.

(1) The premises of every laundry, its fittings, furniture, utensils, equipments and machinery therein shall be maintained in good order and kept clean.

(2) Washing and drying of clothes in a laundry shall be confined within the premise of the laundry.

(3) All washed clothes shall be kept on shelves, containers or tables and not on the floor.

(4) Water from the public water supply shall be used for laundry work unless exempted by the Perbadanan.

(5) Washed clothes shall not be mixed with dirty clothes.

Lending out clothes forbidden

16. No licensee shall lend or hire out or use any clothes entrusted to him in the course of his business.

Ventilation

17. The licensee shall take steps to ensure that there is adequate ventilation in the licensed premises to the satisfaction of the Perbadanan and the relevant authority and shall cause every means of such ventilation to be kept in good order and in efficient working condition.

Prohibition against spitting

18. No person shall spit upon the floor or walls of a laundry.

Prohibition against smoking

19. No person shall smoke in a laundry.

Prohibition of animals

20. No person shall cause or permit any animal to enter or remain in any laundry.

Copy of by-laws and licence to be displayed at laundries

21. A copy of these by-laws and licence, suitably framed, shall at all times be conspicuously displayed in every laundry and shall be constantly maintained in a clean, visible and legible state.

Exemption

22. The Perbadanan may, with or without any conditions, exempt any person from any of the provisions of these by-laws except by-law 3, 9, 10, 11, 13 and 15.

Penalty

23. Any person who contravenes any of the provisions of these by-laws shall be guilty of an offence and shall upon conviction be liable to a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding one year or both such fine and imprisonment and in the case of a continuing offence to a fine not exceeding two hundred ringgit for each day during which such offence is continued after conviction.
