IN exercise of the powers conferred by section 98 of the Local Government Act 1976, the Perbadanan Putrajaya makes and pursuant to section 103 of the said Act, the State Authority confirms, the following by-laws:
1. These by-laws may be cited as the Crematorium (Perbadanan Putrajaya) By-laws 1999 and shall apply only to the Kawasan Perbadanan Putrajaya and shall come into force on the date of their publication in the Gazette.
2. In these by-laws unless the context otherwise requires-
"crematorium" means the crematorium provided in Kawasan Perbadanan Putrajaya by Perbadanan pursuant to section 94(1) of the Local Government Act 1976 [Act 171];
"Kawasan Perbadanan Putrajaya" means the area as described in section 10 of the Perbadanan Putrajaya Act 1995 [Act 536];
"Perbadanan" means the Perbadanan established under section 3 of the Perbadanan Putrajaya Act 1995.
(1) No cremation at the crematorium of the corpse of any deceased person shall be permitted unless an application therefor is made in such form as the Perbadanan may determine.
(2) The application shall be made by one of the following persons-
(a) next-of-kin of the deceased person; (b) a person who is authorised in writing to make the application by next-of-kin of the deceased person; (c) the legal personal representative; (d) any close relative of the deceased person; or (e) any person who has obtained a permit from the police or hospital authorities.
(3) Upon approval of the application the Perbadanan shall issue a permit to cremate subject to-
(a) payment of RM100.00 as for cremation per corpse ; and (b) such conditions and restrictions as may be specified therein.
(4) The permit to cremate shall be in such form as the Perbadanan may specified.
(5) The fees paid for a permit under paragraph (3) shall not be refundable.
(1) No cremation of the corpse of any deceased person shall be permitted at the crematorium -
(a) if it is known, believed, or suspected that the deceased person was a Muslim or if there is doubt as to whether he was a Muslim
(b) if it is known that the deceased person had given any direction or indication, whether verbally or in writing, that his body should be buried
(c) if the identity of the deceased person has not been established
(2) No cremation at the crematorium of the corpse of any deceased person shall be permitted until there is produced to the person in charge of the crematorium a permit to bury lawfully issued in respect of the deceased person.
6. The coffin containing any corpse to be cremated at the crematorium shall be made of wood and shall follow the specification specified by the Perbadanan.
(1) After every cremation, the ashes of the deceased person shall be surrendered to the person who applied for the cremation, if he claims them.
(2) If, within fourteen days after notice has been given to the person who applied for the cremation to collect the ashes, does not do so or if he has indicated that he does not wish to claim them, the ashes shall be interred or scattered at such place as the Perbadanan may determine.
(3) While the ashes remain at the crematorium they shall be properly stored and so marked or placed as to be readily identified.
(1) The person in charge of the crematorium shall keep or cause to be kept a Register of Cremations, which shall be in such form as the Perbadanan may determine and in which shall be entered the following particulars relating to each cremation -
a) the name, identity card number, the residence, occupation, age, sex, religion and marital status of the deceased person b) the name, identity card number and address of the person who applied for cremation c) the date of death d) the cause of death of deceased person e) the date of cremation f) the serial number of cremation g) the reference number of the permit to bury h) the name, designation and address of the person who permit to bury i) the manner in which the ashes of the deceased person were disposed of.
(2) The particulars mentioned in sub-paragraphs (a) to (h) of paragraph (1) shall be entered in the Register of Cremations immediately after the cremation has taken place and the particulars mentioned in sub-paragraph (i) shall be entered as soon as the ashes have been disposed off in accordance with by-law 7.
(1) The person in charge of the crematorium shall secure that all applications, permits and other documents relating to each cremation are numbered, filed in order, and carefully preserved for a period of seven years from the date of the cremation.
(2) The Register of Cremations or any part thereof shall not be destroyed.
