LOCAL GOVERNMENT (COMPOUNDING OF OFFENCES) (PERBADANAN PUTRAJAYA) BY-LAWS 2000

IN exercise of the powers conferred by section 102 of the Local Government Act 1976[Act 171], the Perbadanan Putrajaya makes and pursuant to section 103 of the said Act, the State Authority confirms the following by-laws:

Citation, application and commencement

1.

(1) These by-laws may be cited as the Local Government (Compounding of Offences) (Perbadanan Putrajaya) By-laws 2000.

(2) These by-laws shall apply only to the Kawasan Perbadanan Putrajaya.

Interpretation

2. In these by-laws unless the context otherwise requires -

• "authorised officer" means any officer authorised by the Perbadanan;
• "Kawasan Perbadanan Putrajaya" means the area as described in section 10 of the Perbadanan Putrajaya Act 1995[Act 536];
• "official receipt" includes any acknowledgement by the Perbadanan either manually or by franking or by computer or by any other electronic means;
• "Perbadanan" means the Perbadanan Putrajaya established under section 3 of the Perbadanan Putrajaya Act 1995[Act 536];

Compoundable offences and authorised officer who may compound

3. Offences under sections 69, 70, 74, 75, 76, 77, 78, 82(5), 95, 97, 107(5), 109, 111, 112, 140(2)(a), 160 and 161 of the Local Government Act 1976 and offences under any by-laws made under the said Act may be compounded by the President, Secretary, any Legal Officer, any Legal Assistant of the Perbadanan or any authorised officer .

Sum to be collected and mode of payment

(1) The sum of money to be collected for compounding an offence under the Local Government Act 1976 shall be the amount as set out in the Schedule I.

(2) The sum of money to be collected for compounding an offence under any by-laws made under the Act shall be the amount as set out in the Schedule II.

(3) Payment of the sum shall be made in cash, or by cheque, money order, cashier's order, banker's order, banker's draft made payable to the Perbadanan Putrajaya and crossed "Account Payee Only". Payment may also be made by credit cards or by any electronic means approved by the Perbadanan.

(4) Payment may be made at the office of Perbadanan Putrajaya, Pusat Pentadbiran Kerajaan Persekutuan, 62675 Putrajaya or, if by post addressed to the President, Perbadanan Putrajaya, Pusat Pentadbiran Kerajaan Persekutuan, 62675 Putrajaya.

(5) Every payment received shall be accounted for as money belonging to Perbadanan and an official receipt shall be issued for it to the person to whom the offer to compound was made.

Form of offer to compound

5. The form in Schedule III shall be used for making an offer to compound but may be modified as necessary.

Revocation

6. The Local Government (Compounding of Offences) (Perbadanan Putrajaya) By-Laws 1999 [Sel. P.U 46/99] is revoked.
